  4. Chief Chris Uba signed an agreement with five members representing Anambra State in the National Assembly on the agreement that in return for a guaranteed ticket under the PDP for the Assembly seat in 2011, they will pay him N200,000,00 each. This agreement was entered into via Chris Uba’s company known as KAY-KAY CONSTRUCTION LIMITED and the agreement was structured as a loan agreement with no mention of the election sponsorship.
The said members won the election in 2011 but failed/refused to honor the agreement with Chris Uba. According to them Chris Uba was to pay the said sum as sponsorship for their campaign, a promise he failed to fulfill and they are therefore under no obligation to repay him.
Upon their default, Chris Uba took the matter before the High Court in Enugu and the Chief Judge of Enugu State entered Judgment in favour of Uba under the undefended list procedure on 16/11/2012 in the Sum of N200, 000,000 (Two hundred Million Naira).
Their counsel Dr. Onyechi Ikpeazu, SAN lodged an appeal on their behalf at the Court of Appeal in Enugu on the same 16/11/2012, and upon entry of the appeal at the Court of Appeal, filed a Motion for Stay of Execution of the Judgment at the Court of Appeal. The law is that any writ of execution or attachment issued and the attendant execution carried out during the pendency of a motion for stay of execution is liable to be set aside and in this case, the Motion for Stay of Execution was to the knowledge of the Chris Uba and his counsel pending at the Court of Appeal .
Despite this, Chris Uba moved the officers of the Court to levy execution over their properties in Abuja along with over 50 police men mobilized who in what appeared like a military operation invaded their residence and started seizing and carting away properties and including vehicles in the full glare of the public.
Upon getting wind of the development, the lawyers in Dr Onyechi Ikpeazu SAN & co broght a motion asking the Court to stop further execution and set aside the illegal execution already carried out.
The said Orders have been set aside and the Judge lambasted the lawyer to Chris Uba, Mr A.C. Ozioko for misleading the court, describing his conduct as shameful. The Court further directed the properties to be released to the members of the National Assembly immediately. Till date however, the Chief Registrar of the High Court of the FCT is yet to comply with the Order of Court
